Terms and Conditions
§1 Scope
These General Terms and Conditions (GTC) apply to all courses, classes and events organised by JHE LIFE – Melanie Naumann c/o COCENTER, Kobboldstr. 1, 86551 Aichach (hereinafter referred to as the ‘Studio’).
By purchasing or booking courses, classes or events, customers agree to these GTC.
§2 Conditions of Participation
Participants must be at least 18 years of age. For courses specifically designed for children, the minimum age is 6 years.
Participants agree to take part in classes, training sessions and events at their own risk.
There must be no medical conditions that would contraindicate participation. Pre-existing medical conditions, current health restrictions or pregnancy must be reported to the instructor immediately and without being asked. It is advisable to consult the relevant doctors or therapists before taking part, if necessary. The studio reserves the right to request medical clearance certificates where necessary. The Amanes form must be completed and submitted before attending a class for the first time; otherwise, access to the class may be refused. Any changes must be reported immediately.
Any health problems or discomfort arising during classes must be reported to the instructor immediately.
§3 Purchase of products, payment and booking of classes, training sessions and events
Participation in training sessions requires the purchase of a product and payment via the online booking system or, where specified, by email.
Payment for products can be made in advance or by real-time bank transfer. The studio uses an electronic payment system within the online booking system. Payment by direct debit is not possible.
Any changes to the customer’s name, address or bank details must be notified immediately. Any additional costs arising from culpable omission shall be borne by the customer.
Training sessions can be booked via the studio’s online booking system, by email or by message (where specified). The booking is only considered confirmed once the studio has sent the customer a confirmation.
§4 Prices and Validity
The current prices for courses, classes and events are listed in the studio’s price list and are subject to change at any time without prior notice.
The validity period of courses can be viewed in the price list of the online booking system. The validity of courses may be extended in individual cases; such extensions are to be regarded as a gesture of goodwill on the part of the studio and do not constitute a general entitlement to an extension.
§5 Cancellation
A booking may be cancelled free of charge up to 3 calendar days before the booked date. In this case, any payments already made will be refunded in full. In the event of cancellation less than 3 calendar days before the date, the provider will endeavour to reallocate the vacated place. If this is not possible, 90 per cent of the booked fee will be payable. The customer expressly reserves the right to prove that no loss, or a significantly lower loss, has been incurred.
Instead of cancelling, the customer may nominate a suitable replacement at any time. This is subject to the replacement meeting all participation requirements, in particular being medically fit, and ensuring that the necessary documents, such as a medical history form, are submitted in full and in good time before the event begins. No additional costs are incurred for nominating a replacement.
The client undertakes to arrive on time for the agreed appointment. In the event of a delay, the time missed cannot be made up.
The studio reserves the right to cancel individual sessions or agreed appointments for good cause (illness of the instructor or inability to hold the session at the planned venue). Notification of a cancellation will be provided via the online booking system and by email to registered customers.
As a general rule, there is no entitlement to a refund for the cancellation of full or partial packages or individual sessions. This applies in particular to 10-session passes that have already been started. Arrangements may be made on a case-by-case basis; these are to be regarded as a gesture of goodwill on the part of the studio and do not constitute a general entitlement to a refund. Valid reasons may include: the onset of an illness which would make continued participation impossible or harmful. Relevant medical certificates must be submitted unsolicited and without delay.
§6 Liability
The studio shall not be liable for any damage caused by the clients themselves or by third parties. Clients are obliged to take care of their own health and physical condition and to inform the instructor of any health restrictions. In the event of a breach of this duty to inform, liability is limited to cases of wilful misconduct and gross negligence, provided that the damage is related to a pre-existing condition or physical limitation. Participation in classes, training sessions and events is entirely at the client’s own risk.
§10 Copyright
All content belonging to the Studio, including images, text and designs, is protected by copyright and may not be used without the Studio’s prior written consent.
§11 Jurisdiction
German law shall apply. The place of jurisdiction for all disputes arising from or in connection with these General Terms and Conditions shall be the Studio’s registered office.
§12 Severability clause
Should any individual provisions of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provisions shall be replaced by an appropriate provision that most closely approximates the purpose of the invalid provisions in a legally valid manner.
§13 Final Provisions
These Terms and Conditions form an integral part of every contract between the Studio and its clients.
